Shareholder Agreement
Plant It Forward offers a weekly Farm Share and monthly Cupboard Share in which customers become members of our farm. The member (i.e. Shareholder) then receives a bundle of freshly harvested produce weekly. Cupboard Shareholders receive a bundle of locally-sourced pantry goods monthly. Shareholders must agree to the following terms in order to partner with our farm:
1. Members must agree to purchase their Share in advance. All payments or down-payments must be received before delivery of the Share. Registering for the Farm Share/Cupboard Share is a commitment to pay the entire amount owed. Subscribers who are enrolled in automatic subscription renewal must email Plant It Forward if removing the automatic pay token is desired.
2. Members are responsible for picking up their Share at their chosen location and timeframe each week (each month for Cupboard Shares). Members are encouraged to find someone else to pick up their Share when they will be away. If you or a representative of your family/party is not there to pick up your Share during the designated pick-up timeframe, your Share will be given away, donated, or sold. Missed pick-ups cannot be made up. Members can program delivery holds in their online account. Delivery holds must be placed at least 1 week in advance. During periods of inclement weather or other calamity (e.g. major flooding, hurricane, hard freeze) Plant It Forward reserves the right to disable the ability to place a delivery hold. This is for the financial security of our network farmers.
3. Members understand that the products in their Share will depend entirely upon what is in season and growing on the farm/available for local sourcing. Plant It Forward cannot guarantee any item and is unable to customize Shares for members. Additionally, Plant It Forward sources products from other local farms to bring our Farm Shareholders the best variety. When products are included from partner farms we will indicate the source of those particular products in our email communication to members.
4. Your membership is non-refundable. If you for some reason cannot continue your subscription, Plant It Forward is happy to transfer it to a family or individual of your choice. If you need to change your location part-way through the season, or place a temporary delivery hold on your account, this is possible to do.
5. We promise to do our best to provide you with a bountiful Farm Share each week. The quantity of produce, however, may vary from week-to-week due to extreme weather, pests, natural disasters, or other production factors despite our best efforts. By joining the Farm Share, you are agreeing to share the risk of crop failure with us and other members. In the unlikely event of a crop failure, we may extend the season or compensate for the failed crops by filling your Share with other crops grown on the farm that are ready for harvest at that time. If a large portion of crops fail, we may not be able to deliver any produce for some weeks or at all.
6. Email is the primary method of communication between the farm and customer. Those participating in the Farm Share and/or Cupboard Share agree to open and read all e-mail communications from us as soon as they are noticed.
7. Members will be added to our email newsletter list.
8. A few times a year Plant It Forward will hold farm events where Shareholders are invited out to the farms. Photographs will be taken at these events and Shareholders agree to allow Plant It Forward to use these photographs for marketing purposes.
9. Pertaining to Home Delivery: Shareholders enrolled in Home Delivery further agree to the following terms:
a. Plant It Forward will do our best to deliver to your home within the regular time range specified. However, conditions on the road or other unforeseeable events may result in an early or delayed delivery.
b. The customer is responsible for retrieving their delivery package in a timely fashion. Our packaging does not ensure temperature control. Plant It Forward is not responsible for damaged goods.
c. Plant It Forward will deliver to the customer’s doorstep unless otherwise specified in writing in the customer’s order comments. Be sure to include information such as gate code, unit number, etc. so we can fulfill your delivery.
d. The Home Delivery program was initiated in response to the conditions surrounding the COVID-19 pandemic. The Home Delivery program may be suspended in the future. If the Home Delivery program is suspended, customers will have the option to transfer their membership to our standard neighborhood-based Farm Share/Cupboard Share program, donate their remaining Shares, or receive a refund in the amount of the customer’s remaining balance.
